This Fair Use Policy ("Policy") governs your use of AutoSend's services, APIs, and related products (collectively, "Services"). This Policy is incorporated into and forms part of AutoSend's Terms and Conditions and Privacy Policy. By using AutoSend, you agree to comply with all three documents collectively. In the event of any conflict between these documents, the Terms and Conditions shall take precedence.
If you violate this Policy, we may suspend or terminate your account without prior notice. Accounts found in violation may also be held financially liable for damages caused to AutoSend, its infrastructure, and other customers affected by the violation.
Refunds will not be issued for breaches of this Policy. Additionally, once emails have been sent, refunds will not be issued for partial quota usage.
You may not use AutoSend to:
Send unsolicited or unauthorized messages including spam, bulk email, or chain letters.
Send harassing, abusive, or harmful content such as threats, hate speech, or material that promotes violence or discrimination.
Distribute misleading or fraudulent content, including phishing, scams, impersonation, or deceptive practices.
Transmit illegal or harmful material, including but not limited to malware, viruses, or any content that infringes on intellectual property rights.
Send sensitive personal information without proper consent or legal basis (e.g., credit card numbers, government IDs, health data).
Bypass or abuse deliverability safeguards, suppression lists, or any features designed to protect recipients and maintain service integrity.
Use AutoSend for high-risk activities where failure could result in injury, death, or significant damage (e.g., medical devices, aviation systems, nuclear facilities).
You may not use AutoSend for services or content related to:
Pornography, sexually explicit material, or adult services.
Gambling, betting, sweepstakes, or online casinos.
Unregulated financial services, including binary options, payday loans, or cryptocurrency schemes.
Alcohol, tobacco, vaping, or recreational drugs.
Multi-level marketing (MLM), affiliate spam, or "get rich quick" schemes.
Prescription drugs, supplements, or medical products without proper regulatory approval.
Firearms, explosives, or weapons-related content.
AutoSend reserves the right to reject or suspend accounts in any industry we consider high-risk, even if not explicitly listed above.
To ensure reliable service for all customers, AutoSend enforces reasonable limits on usage. You agree not to:
Exceed reasonable sending volumes beyond what is included in your plan without prior agreement.
Overload our systems with excessive API calls, automated testing, or traffic that disrupts normal operations.
Exploit the free tier by creating multiple accounts or otherwise attempting to bypass paid usage.
Engage in activities that compromise system stability, such as sending to invalid, purchased, or scraped email lists.
AutoSend may apply rate limiting, temporary restrictions, account review, or suspensions if your usage significantly deviates from normal acceptable threshold.
Your complaint rate must be lower than 0.1%.
Your bounce rate must be lower than 4%.
If complaint or bounce rates go above these thresholds, your account may be suspended automatically without prior warning.
You are solely responsible for the content of the emails you send through AutoSend.
You must ensure compliance with applicable laws, including but not limited to CAN-SPAM Act, GDPR, CASL, and other regional regulations.
You must obtain proper consent from your recipients before sending marketing or promotional emails.
You must respect unsubscribe requests and maintain suppression practices.
AutoSend reserves the right to investigate and take appropriate action if we suspect any violation of this Policy. Actions may include:
Suspending or terminating your account immediately and without prior notice.
Blocking delivery of offending emails.
Reporting unlawful activity to relevant authorities, anti-abuse organizations (such as APWG and abuse.ch), and affected parties.
Sharing account details, payment information, and email content with law enforcement or third parties as required by law or in the interest of protecting our platform and its users.
Accounts found in violation may also be held financially liable for damages caused to AutoSend, its infrastructure, and other customers affected by the violation.
In cases of serious abuse, including but not limited to phishing, fraud, impersonation, spoofing, or sending malicious content, AutoSend reserves the right to:
Forfeit any prepaid credits, subscription fees, or deposits without refund.
Seek recovery of direct costs incurred as a result of the abuse, including but not limited to IP and domain delisting fees, legal costs, customer remediation expenses, and costs related to operational disruption.
Pursue liquidated damages of up to $500 per individual phishing or fraudulent email sent through our infrastructure. This figure represents a reasonable estimate of harm caused to AutoSend's reputation, deliverability, and business operations, and is not intended to be punitive.
AutoSend's decision to pursue financial penalties does not limit our right to also pursue other legal remedies available under applicable law.
You agree to indemnify, defend, and hold harmless AutoSend, its parent company Peerlist Inc., affiliates, officers, directors, and employees from any and all claims, damages, losses, liabilities, or costs (including reasonable legal fees) arising from:
Your violation of this Policy or misuse of our Services.
Any content you send through our platform that causes harm to recipients or third parties.
Harm caused to other AutoSend customers whose deliverability, sender reputation, or business operations are negatively impacted by your actions on our shared infrastructure.
This obligation survives the termination of your account.
